Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Aweh platform, website and related services (the "Service") operated by Aweh Commerce (Pty) Ltd ("Aweh", "we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Service. By using the Service you confirm that you meet these requirements and that the information you provide is accurate.
2. Accounts & Merchant onboarding
To sell using Aweh you must register a Merchant account and provide accurate business details. You are responsible for the activity on your account, for keeping your access credentials secure, and for ensuring your WhatsApp Business number and catalogue comply with WhatsApp/Meta's policies and applicable law.
3. Payments & fees
Payments are processed by our third-party payment provider (PayFast), not by Aweh. Aweh does not hold or handle card or banking data. Merchants are responsible for the accuracy of their pricing, for fulfilling paid orders, and for any refunds, disputes or chargebacks relating to their goods or services. Aweh's fees for the Service are as set out in our pricing or in a separate Merchant agreement, and may change on reasonable notice.
4. Merchant responsibilities
Sell only goods and services you are legally permitted to sell; accurately describe your products, prices and availability; fulfil orders that have been paid for, and handle customer queries and refunds fairly; comply with the Consumer Protection Act, POPIA, tax laws and all other applicable South African law; comply with WhatsApp/Meta's Business and Commerce policies.
5. Acceptable use
You may not use the Service to: break the law; send spam or unsolicited messages in breach of WhatsApp/Meta rules; infringe anyone's rights; transmit malware; attempt to gain unauthorised access to the Service; or copy, reverse-engineer, scrape or imitate the platform (see our IP & Legal Notice). We may suspend or terminate access for any breach.
6. Intellectual property
The Aweh brand, software, designs and content are owned by Aweh Commerce (Pty) Ltd and protected by law. Your use of the Service does not transfer any of our intellectual property to you. Full details are in our IP & Legal Notice.
7. Third-party services
The Service relies on third parties including WhatsApp/Meta and PayFast. Your use of those services is subject to their own terms. Aweh is independent and is not endorsed by or affiliated with Meta. We are not responsible for outages, changes or actions of these third parties.
8. Service availability
We work to keep the Service available and reliable, but we provide it "as is" and do not guarantee that it will be uninterrupted or error-free. We may modify, suspend or discontinue features at any time.
9. Limitation of liability
To the maximum extent permitted by law, Aweh is not liable for indirect, incidental or consequential losses, or for loss of profits, revenue, data or goodwill, arising from your use of the Service. Nothing in these Terms limits liability that cannot lawfully be limited, including under the Consumer Protection Act. As between Aweh and a Merchant, the Merchant remains responsible to its customers for the goods and services it sells.
10. Indemnity
You agree to indemnify and hold Aweh harmless from claims, losses and costs arising from your breach of these Terms, your goods or services, or your unlawful or infringing use of the Service.
11. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if required by law or our partners. Provisions that by their nature should survive termination (including intellectual property, limitation of liability and indemnity) will survive.
13. Governing law
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute, subject to any consumer rights that apply.
14. Changes
We may update these Terms from time to time. The "last updated" date reflects the latest version. Continued use of the Service after a change means you accept the updated Terms.
